California Employee Rights Lawyer

California state law, in addition to federal laws, often leads the way across the nation for the most progressive employee-rights laws. As such, being up to date on these laws is important for every employee. At Scott • Wagner and Associates, our California employee rights lawyers strive to educate our clients on their rights of ever-evolving laws like PAGA, the California Fair Pay Act, and the California Fair Employment and Housing Act,. We offer legal assistance to employees who have had their rights violated while in the workplace.

Discrimination and Harassment Prevention

All employees are protected by state and federal laws when it comes to harassment and discrimination. The Equal Employment Opportunity Commission (EEOC) is the primary federal agency that prohibits discrimination and it works with the California state counterpart, the Department of Fair Employment Housing. When filing a complaint with the EEOC and/or DFEH, you will benefit greatly from the legal advice of an experienced attorney. While the EEOC and DFEH may be the first place to begin asserting your rights under the law, we will help you to gather evidence and create a comprehensive case describing the incidents that you have been through in order to maximize your compensation so that further injustices do not occur.

Wage and Hour Rights

In California, under the law, employees must receive one and a half times their regular rate of compensation for every extra hour worked after an eight hour shift or after a 40 hour work week. Once an employee exceeds 12 hours of work in one day, he or she has the right to receive twice the regular hourly wage. There are, however, certain occupations that are exempt from overtime laws, including but not limited to:

  • Employees in the computer software field who are paid on an hourly basis;
  • Student nurses;
  • Taxi drivers;
  • News editors;
  • Professional actors; and
  • Airline employees.

Many of these professions have their own rules regarding hourly rates and overtime, so if you are concerned that you are not receiving pay for the number of hours you are working, please contact a member of our legal team at your earliest convenience.
